Data protection information for the training programme “Guidance and Support of Trainees” and the advanced module completing the continuing education programme “Practice Instruction” pursuant to § 64 GuKG
We handle your personal data carefully and conscientiously. In processing data, we comply with the applicable national and European data protection regulations.
Connexia – Gesellschaft für Gesundheit und Pflege gem. GmbH (hereinafter referred to as “connexia”) and FHV jointly conduct the training programme “Guidance and Support of Trainees” and the advanced module completing the continuing education programme “Practice Instruction” pursuant to § 64 GuKG. With regard to data processing, there is, at least in part, joint responsibility pursuant to Art. 26 GDPR.
Purpose of data processing and data categories:
Participants of the training programme “Guidance and Support of Trainees” and the advanced module completing the continuing education programme “Practice Instruction” pursuant to § 64 GuKG:
We process the following categories of data using automated systems: salutation, name, academic title, employer data including contact information, email address, qualification, course title, final thesis, assignments, press photos.
The programme may, where appropriate, be conducted using virtual communication tools (e.g. MS Teams).
Lecturers of the programme:
Salutation, name, academic title, email address, telephone number, curriculum vitae, qualification certificates, courses taught, evaluations, timetable data.
Employees of connexia:
Salutation, name, academic title, internal contact details (email address, telephone number).
Data processing (excluding press photos) is carried out for the purpose of organising and implementing the training programme “Guidance and Support of Trainees” and the advanced module completing the continuing education programme “Practice Instruction” pursuant to § 64 GuKG.
The creation of press photos is carried out without any entitlement to financial compensation. The photos may be used for marketing purposes by FHV. The processing serves primarily marketing purposes through the use of modern media using this image material (e.g. on the FHV GmbH website, in social media, etc.) and is essential to ensure the competitiveness and continued existence of FHV. Use is limited to what is necessary for the institutional purpose and is carried out in a transparent manner and with the implementation of appropriate technical and organisational security measures to protect the data.
Legal basis:
We process the above-mentioned data, excluding press photos, on the legal basis of Art. 6 para. 1 lit. b) GDPR for the performance of a contract.
The provision of personal data is neither legally nor contractually required. However, it is necessary for participation in the programme or advanced module. If you do not provide us with the personal data, participation is not possible.
The creation and publication of press photos is based on the overriding legitimate interests of FHV pursuant to Art. 6 para. 1 lit. f) GDPR, which lie in carrying out marketing activities to ensure competitiveness. Please inform the persons taking photos directly if you do not wish to be photographed. Nevertheless, it cannot be guaranteed with absolute certainty that your image will not appear in any photo. The creation of photo and video recordings, as described above, is based on the overriding legitimate interest of FHV.
As a data subject, you have the right, in accordance with Art. 21 GDPR, to object to the processing of your personal data.
There is no legal or contractual obligation to appear in press photos.
Recipients:
Data processing is carried out by FHV using Microsoft 365, MS Office. Further information about Microsoft 365 can be found at https://privacy.microsoft.com/de-de/privacystatement.
In addition, personal data is partially processed jointly with connexia (https://www.connexia.at/). Data processing predominantly takes place on the systems of connexia. More information about connexia’s data protection can be found at https://www.connexia.at/datenschutz/.
Retention period:
The storage and retention period is based on legal requirements (e.g. the Federal Fiscal Code – BAO) or for as long as FHV has a legitimate interest in the data.
Any image material produced in relation to your person will be stored for as long as necessary for the purposes for which it is processed. In particular, the storage duration depends on the type of image (number of persons, environment depicted), the context in which the photo was taken (public event, lecture), suitability for documenting the history of FHV, suitability for use in anniversary publications and commemorative publications, suitability for use on the website and in social media/networks, YouTube, etc., the degree of intrusion into privacy interests, and its relevance for archiving purposes.
Your rights under the GDPR:
We would like to inform you that you generally have the rights to access, rectification, erasure, restriction, data portability, withdrawal and objection with regard to your personal data. Requests or applications in this context can be sent to datenschutz@fhv.at.
If processing is based on your consent, you may withdraw this consent at any time by emailing datenschutz@fhv.at.
If processing is based on the legitimate interests of FHV, you may lodge a justified objection in accordance with Art. 21 GDPR.
The lawfulness of the processing carried out until the time of withdrawal or objection remains unaffected.
The point of contact for exercising your data subject rights is connexia – Gesellschaft für Gesundheit und Pflege gem. GmbH (https://www.connexia.at/); however, asserting your rights with FHV is also permitted.
If you believe that your data is being processed unlawfully, we kindly ask you to contact us at datenschutz@fhv.at. Furthermore, you have the right to lodge a complaint with the Austrian Data Protection Authority, which is the competent supervisory authority.
