The FHV Assistant is a chatbot integrated into our website www.fhv.at that uses generative AI and all content already published on www.fhv.at to answer freely formulated questions from prospective students of our degree programmes in the best possible way. In particular, it is trained to direct prospective students to the relevant official websites.
Terms of use
1. Scope of application
These terms of use govern your use of the publicly available generative AI service, the chatbot "FHV Assistant" of Fachhochschule Vorarlberg GmbH (FHV for short). By using the chatbot "FHV Assistant" you agree to these terms and conditions.
Service description:
The FHV Assistant offers automated answers to questions about study and event offers and other interesting topics related to the FHV. The output of the FHV Assistant may be incomplete, outdated or incorrect and is intended to provide initial information. They do not replace specific advice on the individual courses offered and related questions.
2. Permitted use, rules of conduct
You can use the FHV Assistant to ask questions about the courses and events offered by the FHV. You may only use the outputs (answers) of the FHV Assistant for private purposes.
You undertake not to use the FHV Assistant for
- unlawful activities (including offensive, discriminatory, violence-glorifying, ... content);
- violation of third-party rights (personal rights, data protection rights, copyrights and trademark rights);
- Distribution of malware, spam, phishing or circumvention of security mechanisms;
- Entering sensitive data;
3. User content and responsibility
You are responsible for the content you enter. You confirm that you have the necessary rights to make entries in the FHV Assistant. You understand that AI-generated text may contain errors or biases or be misleading. You are responsible for verifying the accuracy and appropriateness of all output. As a user, you assume all risks associated with your use of the FHV Assistant. You indemnify the FHV against claims by third parties resulting from your unlawful use of the chatbot or violation of these Terms of Use, including reasonable legal defense costs.
4. Limitations of liability and warranty exclusions
To the extent permitted by law, the FHV shall not be liable for any damages incurred by you or any third party in connection with your use of the FHV Assistant or for any errors, inaccuracies or misleading content caused by your use of the FHV Assistant.
The FHV Assistant may be used as provided, without further representations or warranties as to availability, accuracy, correctness of output, fitness for a particular purpose.
The FHV does not guarantee that the FHV Assistant will be available at all times.
The FHV takes state-of-the-art technical and organizational measures. These do not offer absolute security: you are also obliged to implement your own security measures (e.g. secure passwords, access protection).
Data protection declaration
The protection of your data is of the utmost importance to us. Our privacy policy for the FHV Assistant explains how potentially personal data is collected and used.
Data collection, purpose and legal basis
The Fachhochschule Vorarlberg GmbH (FHV for short) offers - optionally and voluntarily - an AI-based chatbot called FHV Assistant to interested users of our public website www.fhv.at. Data entered ("prompts") are not used to train the AI models used and are only processed for a short time.
The data processing that takes place in the course of using the FHV Assistant serves in particular to provide information on FHV degree programmes. The application is intended to arouse and promote the interest of potential applications in our range of degree programmes.
The data processing described does not involve automated decision-making or profiling. Please do not disclose your own personal data or the personal data of third parties.
There is no obligation to provide your personal data. As use is voluntary, you will not suffer any disadvantages if you do not provide your data - apart from the fact that the tool cannot be used.
In particular, the following personal data is processed when using the FHV Assistant:
- Content data: Your text entries, e.g. questions about our degree programs
- Technical usage data, unique identifiers (e.g. call ID, session ID, IP), timestamp and IP address and costs (e.g. token consumption). Technical usage data is not processed further or transmitted to third parties and is used purely to provide the service and control costs.
- After use, all data is deleted immediately, with the following exceptions
- Your text entries ("questions") and the costs incurred by the request are stored pseudonymized, i.e. without any personal reference, in order to be able to optimize our information offer on www.fhv.at and the FHV Assistant based on typical user questions at a later date.
The processing of personal data is carried out on the legal basis of Art. 6 para. 1 lit. b GDPR, as the processing is necessary for the implementation of pre-contractual measures (provision of information prior to the conclusion of a training contract, if applicable), which are carried out in response to inquiries from interested parties. Furthermore, the processing is carried out on the legal basis of the legitimate interests of the FHV pursuant to Art. 6 para. 1 lit. f) GDPR, which consist in providing a modern and efficient offer via the website for the rapid retrieval of information for website visitors.
KI specifics and quality disclaimer
Probability of error: Generative responses may hallucinate, be incorrect in context, contain outdated information, exhibit bias, or otherwise be false and misleading.
Duty to review: Outputs (responses) must be reviewed and critiqued before decisions are made based on them.
Third-party sources: Even if the issues (answers) refer to third-party sources, no guarantee is given for accuracy, completeness and up-to-dateness.

The commissioned processors are
- Elevantiq GmbH, Rennfeld 15, 6370 Kitzbühel, Austria - for the purpose of integrating the FHV Assistant into www.fhv.at
- Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland - for the purpose of responding to user text input based on Azure AI services and language models and within the framework of the EU Data Boundary. Your data protection rights under the GDPR
We would like to point out that you generally have the rights to information, correction, deletion, restriction, data portability, revocation and objection with regard to your personal data. You can send inquiries or requests in this regard to datenschutz@fhv.at.
If the processing is based on consent, you can also revoke this consent at any time by sending an email to datenschutz@fhv.at; if the processing is based on the legitimate interests of the FHV, you can raise a justified objection to this, whereby the lawfulness of the data processing carried out on the basis of the consent up to the revocation or objection remains unaffected.
If you are of the opinion that data processing is unlawful, please contact us at datenschutz@fhv.at. In addition, you have the right to lodge a complaint with the Austrian Data Protection Authority as the competent supervisory authority.
